Dwa tygodnie temu zakończyliśmy nasz świąteczny projekt marketingowy – patentowy kalendarz adwentowy. Nie chcielibyśmy, aby odnalezione wówczas wybitne świąteczne wynalazki zginęły w otchłaniach sieci społecznościowej. Pozwalamy więc sobie przedstawić je także tutaj. Tym razem mieliśmy też miejsce, aby dla każdego wynalazku zaprezentować pełną treść ochrony uzyskanej w wyniku patentu lub wnioskowanej przez zgłaszającego (niestety większość zgłoszeń przedstawionych w naszym cyklu zakończyła się odmową lub umorzeniem patentowania). Licznik dobrych uczynków

Zastrzeżenia:
1. A “Naughty or Nice Meter” grading product comprising of 12 behavioral questions, a calculator and a “Meter” numbered in a range from Zero (0) to Sixty (60).

Niestety – mamy odmowę. Ekspert USPTO zarzuca brak jasności zastrzeżeń (niejasność pojęć „behavioral questions” i „meter”), a przede wszystkim brak poziomu wynalazczego – rozwiązanie jest oczywiste w świetle stanu techniki. Nowe, „świąteczne” cechy odnoszą się wyłącznie do niepatentowanej treści informacji, a nie rozwiązania technicznego. Patrząc na te amerykańskie zgłoszenia patentowe, rodzi się pytanie – kogo stać na zgłaszanie takich rzeczy w urzędzie patentowym. Koszty uzyskania patentu w USA są kilkukrotnie większe niż w Polsce, a jednak wciąż w rejestrach wiele jest całkowicie chybionych zgłoszeń.
Stelaż na Jemiołę
Patentowy Kalendarz Adwentowy – dzień 3. Chyba największy hit naszego świątecznego cyklu. Innowacyjny stelaż na jemiołę sprawi, że nie umknie Ci żadna okazja do pocałunku. Zwiększa urodę, zwiększa charyzmę.
Patent US4488316. Mistletoe supporting headband. Patent został udzielony w 1984 r. i pozostawał w mocy aż do 1993.

Zwracamy przy tym uwagę, że amerykańskie patenty wzornicze bliższe są naszym wzorom przemysłowym niż patentom na wynalazki. W tym patencie chroniony jest wygląd produktu, a nie jego cechy techniczne.
Detektor Świętego Mikołaja

Kiedy wczytamy się w zastrzeżenia, okaże się, że zgłaszający ubiegał się o ochronę… listu od Świętego Mikołaja. Na szczęście USPTO stanął na wysokości zadania i odmówił udzielenia patentu. Gdyby nie to, Mikołaj miałby problem.

Patentowy Kalendarz Adwentowy – dzień 9. Rolą rzecznika patentowego jest takie sformułowanie zastrzeżeń, aby nie zawężać w nieuzasadniony sposób uzyskanej w wyniku patentu wyłączności prawnej. Można zgłoszenie ograniczyć do detektora Świętego Mikołaja (jak we wczorajszym zgłoszeniu), a można określić je…hmmm… za pomocą bardziej generycznego sformułowania: 1. A holiday key entertainment system, (…) comprising: a holiday key (…) deactivating the illumination at some point during the night, indicating a holiday persona visited the residence;
W tym opisie jest jeszcze jeden smaczek! W odróżnieniu zastrzeżeń, opis może zawierać wiele dodatkowych elementów. Niespecjalnie są one weryfikowane. Jest tu więc miejsce na puszczenie oczka do czytelnika:
1. The illuminating holiday key 100 is shown hung on a door 202 of a house 200 in FIGS. 3 and 4. In FIG. 3, the illuminating holiday key 100 bow/key handle 104 had been turned, emitting Ran illumination 120. Uwaga! Uwaga! To NIE jest wzór przemysłowy! To jest wynalazek. Zastrzeżenie jest bardzo szerokie i nie mówi nic o bałwanku:

Czyli istotą wynalazku jest wypełnienie pamperka (soft figure) miękkim balastem w jego dolnej części oraz przymocowanie do jego spodu materiału antypoślizgowego. Bardzo ciekawe wykorzystanie patentu na wynalazek do ochrony elementów drobnego wzornictwa przemysłowego.
Spór patentowy o sztuczną choinkę

Unieważniony decyzjami kolegium orzekającego ds. spornych UPRP 28 listopada 2019 roku (Sp. 22.2019 i Sp. 23.2019). W sprawie interesujące są zwłaszcza dwie rzeczy: szeroki zakres zastrzeżeń i przebieg postępowania spornego. Jak podaje red. Fedorowicz w swoim Newsletterze, brak nowości wzoru w dacie zgłoszenia został wykazany głównie poprzez zeznania świadków. Ten przykład pokazuje jak dobrą ochronę może dać prawo ochronne na wzór użytkowy. W praktyce jego zakres bardzo zbliża się do zakresu patentu na wynalazek. Zastrzeżenie niezależne:
1. Gałązka choinki z tworzywa sztucznego zbudowana z konaru (1) i odnóg (2), w której zarówno konar (1) jak i jego odnogi (2) owinięte są tworzywem sztucznym znamienna tym, że w miejscu styku konara (1) i odnogi (2) znajduje się obejma (3) zaciśnięta wokół nich
Każdy produkt, który można opisać za pomocą powyższych cech, naruszałby udzielone prawo ochronne. Nie dziwi więc, że aż trzy podmioty wystąpiły o unieważnienie tego prawa. Wskazaną w opisie zaletą chronionego rozwiązania jest to, że: „gałązka zgodna z wzorem użytkowym zapewnia większe bezpieczeństwo użytkownika, oraz poprawia w sposób istotny estetykę wykonania całej choinki, jak również ułatwia sposób produkcji samej choinki, gdyż np. obejmy (3) w postaci zszywek mogą być zaciskane przy użyciu zszywacza lub innego urządzenia do zaciśnięcia”.
